Disclosure Rules
The Canada Revenue Agency (CRA) has developed very specific disclosure rules that must be followed. If disclosure is made to an accountant, there is no privilege. The accountant must divulge to CRA everything he or she knows about your tax position. One major benefit of coming to a lawyer is that most communications between the client and the lawyer are protected by solicitor-client privilege. Provided the taxpayer has not made prior disclosure of his tax position to CRA or an accountant, the information disclosed to his lawyer is protected.
